Judge sets hearing in Barry Beach case

Helena, Montana (AP) November 2010

A Lewistown judge has said he’ll hear arguments next summer in an effort by Montana State Prison inmate Barry Beach to get a new trial.

Beach is serving a 100-year prison sentence for the 1979 beating death of Kimberly Nees on the Fort Peck Indian Reservation.

last week, District Judge E. Wayne Phillips set a hearing Aug. 1-5, 2011, to hear what Beach says is new evidence that links a group of girls to Nees’ death.

The Great Falls Tribune reports Beach’s legal team hopes the new evidence will convince Phillips to order a new trial.
