Rounds spared from lawsuit deposition

A federal magistrate judge says former Gov. Mike Rounds doesn’t have to answer questions from lawyers for an Indian tribe that is suing the state over a gambling compact.

The Flandreau Santee Sioux Tribe’s lawsuit says the state has unfairly prevented it from adding slot machines at its casino in Flandreau. The tribe’s lawyers sought to depose Rounds as part of the evidence-gathering process before trial.

Lawyers for the state filed a motion to block the tribe’s subpoena. They argued that Rounds wasn’t directly involved in negotiations with the tribe and that high-ranking officials like a governor can’t be deposed except under extraordinary circumstances.
