Judge allows Arizona to continue casino suit

Phoenix, Arizona (AP) June 2011

A federal judge says Arizona can proceed with its lawsuit against an Indian casino planned near Glendale.

U.S. District Court Judge David Campbell issued his ruling earlier this month.

The Tohono (toh-HO’-noh) O’odham Nation has permission from the federal government to put 54 acres near the city’s sports and entertainment district into the reservation system in a move aimed at building a casino. That federal decision is being challenged in a federal appeals court later this year.

Arizona and the Gila River Indian Community filed suit in February to stop the casino on grounds that it would violate the state’s gaming compacts with 17 Indian tribes.

The Arizona Republic reports Campbell dismissed some claims including that the Tohono O’odham negotiated their state compact while secretly planning to build a casino in the Phoenix area.
