Motion seeks dismissal of 5 from Navajo fraud case

Attorneys prosecuting a fraud case on the Navajo Nation have asked a judge to dismiss five more defendants from a civil complaint.

Dozens of former and current tribal officials have been accused of defrauding the tribal government in the use or management of $36 million in discretionary funds.

Prosecutors filed a motion to drop charges of breaching fiduciary duty against Danny Simpson, Jonathan Nez, George Apachito, Charles Damon, III and Lorenzo Curley. A tribal judge agreed to drop charges against four others earlier this year.

Prosecutors say they expect that most of the defendants’ cases will be settled, dismissed or result in ethics complaints.

But they say some Tribal Council delegates misused discretionary funds to benefit family members and would pursue charges against them.
