Hearing delayed for man accused in stabbing

Muskogee, Oklahoma (AP) 10-07

Motions filed in the case of a man accused of fatally stabbing the mother his 10-month-old son lead to a delay of his preliminary hearing.

A hearing for Enrique Pacheco, 18, was set to begin on October 2nd. A Muskogee County judge put off the hearing until Nov. 13 after Pacheco’s attorney, Lloyd Payton, filed paperwork on October 1st to suppress the police report, DNA and other issues.

Prosecutors allege Pacheco fatally stabbed Lisa Poor Bear at a local motel Aug. 13.

Muskogee County Assistant District Attorney James Walters said some of the discovery items sought by the defense do not have to be submitted until after the preliminary hearing. But both sides plan to try to reach an agreement, Walters said.

Pacheco remains jailed without bond.

Poor Bear is the adopted daughter of Lisa Tiger, who is a member of a prominent American Indian artist family.

“I think he should stay in jail for the rest of his life,” Dana Tiger, Poor Bear’s aunt, said as she watched Pacheco being escorted from the courtroom. “My niece is dead, and she’s not coming back. She tried to protect herself, and we all failed her. We need to be sure this can’t happen to anyone else by him.

“It’s pitiful – my heart is broken.”
