Oglala councilman indicted on drug charges in N.M.

Rapid City, South Dakota (AP) 10-07

An Oglala Sioux Tribe councilman from the Pine Ridge reservation has been indicted in New Mexico on federal drug charges.

Don Garnier, 38, was arrested Sept. 19 on Interstate 25 near Raton with Anthony Vocu, 42.

They are charged with conspiracy and possession with intent to distribute less than 110 pounds of marijuana.

Garnier and Vocu were scheduled arraigned Oct. 25 in U.S. District Court in Albuquerque, according to court documents.

Authorities said they found 21 pounds of marijuana in the trunk of the car Vocu was driving. Garnier was the only passenger.

They were stopped at a checkpoint set up to verify driver’s licenses, registrations and proof of insurance. Garner and Vocu acted nervous so officers got a search warrant, according to a police report.

Garnier told officers at the scene he did not know there were drugs in the car.

The Oglala Sioux Tribe’s constitution requires officials convicted of a felony to be removed from office. Tribal officials could not be reached for comment.
