State appeals ruling on Narragansett land to U.S. Supreme Court

Providence, Rhode Island (AP) 10-07

The state has appealed to the U.S. Supreme Court a decision allowing the Narragansett Tribe to largely remove 31 acres of land from state control.

The 1st U.S. Circuit Court of Appeals recently ruled the Narragansetts should be able to place the Charlestown parcel into federal trust. That means the land would be governed by tribal and federal law.

Narragansett leaders have said they want to build an elderly housing complex on the site.

But lawyers for Attorney General Patrick Lynch, Governor Don Carcieri and Charlestown town authorities warn that if state law doesn’t apply, the tribe could open a casino there.
