State police sergeant testifies in trial of Narragansetts

A state police sergeant says he never had time to present a search warrant before officers raided a Narragansett Tribe smoke shop nearly five years ago.

Sergeant Donald Devine testified in Providence Superior Court in the trial of seven Narragansett tribal members, including Chief Sachem Matthew Thomas, who were arrested during the July 2003 raid for resisting arrest and scuffling with police.

Police raided the shop because it was selling cigarettes without state taxes.

Devine says he arrived at the smoke shop on the day of the raid with the warrant folded in his back pocket. He says he never had a chance to show it, though he did present it to the tribe’s lawyer after tribe members were placed under arrest.
