Nearly 21 years for racially tinged shooting death in Marysville

A man who got into a fight for some racial comments at a tavern and shot an American Indian to death in Marysville faces nearly 21 years in prison.

Before being sentenced for first-degree manslaughter, 47-year-old Kevin Jory Braa of Marysville said he was sorry that 35-year-old Simeon Whitney of Wapato had to die.

Snohomish County Superior Court Judge Ellen J. Fair took issue with that. Braa was barred from having a gun because of a drug conviction in 1994, and the judge said that if he hadn’t taken a loaded 9 mm pistol to Kuhnle’s Tavern on Nov. 11, 2006, Whitney would still be alive.

Evidence showed Braa took a book on Nazi paratroopers into the tavern, got into a fight after making racial comments, killed Whitney and later said he had shot a “subhuman."
