Opponents will appeal Lawrence trafficway route

Lawrence, Kansas (AP) January 2011

The long legal battle over the route for a South Lawrence Trafficway will continue.

Environmental groups and some Haskell Indian National University students say they will appeal a federal court ruling that allowed the trafficway to be built through a wetlands.

Bob Eye, an attorney for the opponents, told the Lawrence Journal-World last week that the appeal will be filed with the U.S. 10th Circuit Court of Appeals in Denver in the next few days.

U.S. District Judge Kathryn Vratil in November upheld a federal decision to run the trafficway through the northern part of the Baker wetlands. The opponents want the road to be built south of the wetlands.

Joe Erskine, deputy secretary of transportation for the Kansas Department of Transportation, says the agency expected the opponents to appeal the ruling.
